OPA LEGISLATIVE UPDATE
by: Stewart Beasley, Ph.D.
The Psychologist-of-the-Day program has continued to be very successful and a real plus for psychologists in Oklahoma. It remains unique to the legislatures of the individual states. This fantastic public relations opportunity provides a constant reminder to the legislature of our presence. More so, psychologists learn about the effectiveness of speaking to their legislators.
OPA's Legislative Affairs
Committee is pleased to report that workers comp language sought
by OPA was included in SB 1X signed into law June 6, 2005, by
Governor Brad Henry. The change eliminates the requirement that
psychologists work "under the direction of a medical doctor."
This is a reform that several OPA members have sought for a
number of years. OPA was also successful in adding
psychologists back into the law after the original version of
HB 2046 eliminated all references to psychology. HB 2046
eventually died and was replaced by SB 1X. Thanks to all of you
who made calls and/or sent letters. The revised language is
show below, as is an updated tracking report.
"E. The term "physician" as used in this section shall
mean any person licensed in this state as a medical doctor,
chiropractor, podiatrist, dentist, osteopathic physician or
optometrist. The Court may accept testimony from a psychologist
if the testimony is made under the direction of a
medical doctor requested by the Court. If an
injured employee should die, whether or not the employee has
filed a claim, that fact shall not affect liability for medical
attention previously rendered, and any person entitled to such
benefits may enforce charges therefor as through the employee
had survived."
Each psychologist should send a letter to his/her legislator at the end of the session to thank him/her for the willingness to serve. One does not need to agree with all actions of the legislator but a thank you is not a bad idea! ALL OF YOU - KEEP IN CONTACT WITH YOUR LEGISLATOR - PLEASE!!!!
